1. The service provider
shop.viatransilvanica.com is an online store, a retail service owned and promoted by Ținutul de Nord SRL, based in Tiha Bârgăului commune, Piatra Fântânele village, Obcioară str. no. 97, Bistrita-Năsăud county, legal entity registered at the Trade Register with no. J6/451/2018, no. tax registration number RO39256544.
Ținutul de Nord SRL is licensed to use the Via Transilvanica brand, being the official store of the Via Transilvanica long-distance trail.
This document establishes the terms and conditions of use of the shop.viatransilvanica.com website (hereinafter referred to as the "Website") and the conditions for the purchase of products sold through this Website (hereinafter referred to as the "Terms and Conditions").
The Terms and Conditions apply to all transactions between Ținutul de Nord SRL and any customer/buyer completing an order on the shop.viatransilvanica.com website. Tinutul de Nord SRL can modify the Terms and Conditions at any time when appropriate, without prior notification to the Buyer. By placing an order on the shop.viatransilvanica.com website, the Buyer accepts the Terms and Conditions.
2. Definitions and Terms
Seller/Supplier: Ținutul de Nord SRL, legal entity that sells products via the shop.viatransilvanica.com website
Customer/buyer: any natural person over the age of 18, legal person or any legal entity that places an order on the shop.viatransilvanica.com website.
Command: an electronic document, which acts as a form of communication between the Seller and the Buyer, through which the Buyer conveys to the Seller, through the shop.viatransilvanica.com website, his intention to purchase products. An order is considered completed when all steps are completed and after receiving the order confirmation via email.
Site – the online store hosted at the web address shop.viatransilvanica.com and its subdomains.
Goods and Services - any product or service available on the Website.
Content:
- all information on the Website that can be viewed or accessed using an electronic device;
- the content of any e-mail sent to Buyers by the Seller by electronic means and/or any other available means of communication;
- any information communicated to the Buyers by any means by the Seller, through his employees or collaborators, specified or not by him;
- information related to the Goods and/or the rates charged by the Seller in a certain period;
- data relating to the Seller or other privileged data thereof.
3. Information about the products and services offered, copyright and copyright
All products, Goods and Services, Content and design of shop.viatransilvanica.com, as well as any other related material sent to the Buyer by email or provided in any other way belong to ȚINUTUL DE NORD SRL and/or its collaborators and are protected by the law regarding intellectual property. The materials constituting the Website and the Content may not be used or reproduced without prior written permission from the legal representatives. Frames (frames in the sense of the HTML language) or framing techniques (framing techniques in the sense of the HTML language) may not be used for brands, logos or other information protected by copyright law (including images, texts, interfaces, forms) of Website without prior written permission from ȚINUTUL DE NORD SRL.
4. Rights and Obligations of the Parties
ȚINUTUL DE NORD SRL has the right to modify the Terms and Conditions, the Goods and Services and the Content of the Website (any data, images, etc.) without prior notification to the Buyer.
TINUTUL DE NORD SRL has the right to refuse any return that does not meet the conditions of the Return Policy.
The Buyer has the obligation to provide correct and complete data in the Order, so that it can be confirmed and delivered by the Seller and its collaborators. Failure to provide correct and complete information may result in the Order being refused.
5. Billing, Payments and Delivery Policy
To place an order, it is necessary to add the desired products to the Basket, fill in the delivery and billing data, correctly and completely, and pay the Order by one of the existing methods: online card, cash on delivery. No other payment method is accepted.
The order is considered completed upon receipt of its confirmation email.
For orders with delivery in Romania:
- The transport of orders in Romania is done by the courier company Cargus or Sameday.
- Payment methods: by card directly on the website / on delivery by cash on delivery
- Shipping costs differ depending on your option as follows: 17 lei standard rate, and for orders over 220 lei we provide free shipping*
Parcel delivery time is generally between 3 and 7 working days. We live in the mountains, far from the city (50 km), so it may take a little longer to get to you, but don't worry, and if we're going to get snowed in, we'll still make it and send it. Also, there may be some delays during public holidays.
*Attention: "Free shipping for orders over 220 lei" applies to orders of at least 220 lei (VAT included), and delivery is made by fast courier.
For orders with delivery outside Romania (International Shipping).
- Orders are shipped outside of Romania via DHL Express World Wide.
- DHL is one of the fastest, safest and most reliable courier companies in the world, which is why it can be more expensive than the post (if anyone still wants us to send by post, please contact us before placing the order at the shop @viatransilvanica.com and we are lookinga solution).
- Costs vary by destination country and weight. For orders weighing more than 2 kg, additional charges may apply.
- Payment is made exclusively online with a bank card (Visa, MasterCard).
- Payments are made through the NETOPIA Payments payment processor, and bank fees are borne by us following the conversion (card currency - lei).
- For some high value orders it is possible to collect customs duties upon delivery of the parcel. This differs from country to country and certain customs duty thresholds.
- Delivery time differs by region. As a rule, it takes 5-7 working days for European Union countries, non-EU European countries, Canada, Mexico and the United States of America, and 10-14 days for other countries. This is also influenced by the fact that we live and send the parcels in the middle of the Carpathian Mountains, from the headquarters of Via Transilvanica, and some weather conditions can slow down the collection of the parcel. In any case, we somehow manage to send the package, even if we get snowed in.Also, during the periods of public holidays in Romania, certain delays may occur.
The prices of products, Goods and Services include VAT (5%, 19%). The delivery fee is NOT included in their price, but is calculated and added at the end of the order, depending on the delivery address and payment method specified by the Buyer.
Invoicing is done exclusively online, after order confirmation and payment confirmation, and will be sent exclusively digitally to the Buyer. The invoice is valid without the signature and stamp, according to art. 319 para. 29 of law 227/2015.

8. Dispute Resolution
The applicable law for resolving disputes is Romanian law. Disputes can be resolved amicably, through mediation or by resorting to the competent courts. You can also use the online dispute resolution platform: https://ec.europa.eu/consumers/odr/main/?event=main.home2.show
The buyer has the right to appeal to the competent authorities (ANPC) for grievances.
